*Detainee Ahmad Saifi narrowly escapes certain death*

September 2, 2024

The lawyer of the commission managed to visit detainee Ahmad Deeb Hasan Saifi, 34, from Birzeit/ Ramallah, who exits in Remon prison, after 10 months of interruption.
Saifi recounted horrific details that affected his life, including torture methods that the human mind cannot comprehend, which resulted in fractures in right hand, both shoulders, rib cage and bruises in the head.

The lawyer quoted Saifi: “on October 15, 2023, while I was in Negev prison, Yamam, Metsada and keter special forces entered the section and started to beat me intensively until I lost consciousness. I woke up after two hours and lost memory for 24 hours. When I regained my memory, the director of the prison informed the jailers that I am the representative of Hamas inside the prison, where they started to beat me on the head for 10 minutes “.

“On October 26, 2023, soldiers with their dogs stormed our room and handcuffed me with other 9 detainees. They abused and beat us in a brutal manner and then left me alone in the room. One of the jailers stepped on my neck, then a unit of special forces entered accompanied by an officer, putting an M16 machine gun towards my head saying:(Should we kill you or will you commit suicide by yourself? This term is always repeated during every attack against me. Then, 8 guards started beating me severely while I was on the ground. One of them lifted my hands, which were cuffed, and broke my shoulder so that it was pushed forward. They twisted my arms from behind my back to the front, over my head, and down to the ground. They then returned me to the room and continued to assault me, causing chest fractures. I wasn’t able to stand up, they dragged me on the ground and put me and other detainees on top of each other in a bathroom of 1.5 meters. They brought in dogs and filmed us”.

The lawyer of the commission confirmed that the abuse did not stop there. On November 15, 2023, jailers of keter unit attacked Saifi and beat him brutally with iron sticks, causing wounds on his head, fractures in his right hand, with bones out of his skin that caused a bleeding. They transferred him to the clinic and made stitches and then returned him to the room. Afterwards, another unit of special forces entered his room, spraying him with gas 8 times and transferring him to the solitary confinement, leaving him without food or water.
He was transferred next day from the cell to the bathroom. He was shocked when he found that the toilet’s floor is covered with broken glass, as the jailer forced him to walk barefoot on the broken glass. He remained 14 days walking on it for long hours.

Saifi concluded his testimony “on November 29, 2023, an officer threw me to the ground and jumped on my back trying to break it, during transferring me to Remon prison”.
It is worth mentioning that Saifi was detained on August 19, 2009, and sentenced to 19 years and 7 months.

National Day for the Retrieval of Martyrs' Bodies - August 27th

National Day for the Retrieval of Martyrs' Bodies - August 27th
Facts about the Martyrs Whose Bodies are Held in Numbered Cemeteries, Refrigerators, and the Sdeh Teiman Military Base:
The number of martyrs whose bodies are held amounts to 552, including 256 in numbered cemeteries and 296 since the return of the policy of holding bodies in 2015. Among them are:
- 9 female martyrs.
- 32 martyrs from the captive movement.
- 55 children under the age of 18.
- 5 martyrs from the 1948 occupied territories.
- 6 martyrs from Palestinian refugees in Lebanon.
Since the start of the genocide against our people in Gaza, the occupation has escalated its policy of holding bodies. Since the war, the occupation has held 149 bodies, which constitutes more than half of the martyrs held since 2015. It is important to note that this figure does not include the bodies held from the Gaza Strip. The number of martyrs from Gaza held by the occupation is estimated to be in the hundreds, but there is no official statement from the occupation regarding the actual number of bodies from Gaza to this day.
**Key Data on the Crime of Holding Martyrs' Bodies (As a Systematic Historical Policy):**
The crime of holding martyrs' bodies, practiced by the Israeli occupation, is one of the prominent historical policies used as part of the crime of collective punishment against martyrs and their families, and as a mechanism of control and punishment of Palestinians. This issue has passed through several stages and has been closely linked to the escalating level of resistance and confrontation against the Israeli occupation system. Since the occupation of Palestine in 1948, the occupation has used this policy, continuing its implementation until 2008, and resumed it with a decision by the Israeli cabinet in 2015, at the beginning of the popular uprising. The occupation did not stop at holding the bodies but also imposed certain conditions when returning the bodies. It also applied a classification policy as part of the conditions imposed on families, particularly affecting martyrs with Jerusalemite identities, by imposing harsh and unjust restrictions in the context of the occupation's desire for revenge against the living and the martyrs.
This issue underwent legal transformations since 2017. On December 14, 2017, the so-called Israeli Supreme Court decided to postpone its ruling invalidating the holding of martyrs' bodies to allow the Israeli authorities to legislate clear and explicit provisions authorizing the military and police leadership to hold martyrs' bodies. In September 2019, the Supreme Court issued a decision allowing the military commander to hold the martyrs' bodies and bury them temporarily for use as bargaining chips in negotiations. It also imposed broad conditions authorizing the previously mentioned authorities to issue orders to hold the bodies of some martyrs. In reality, the vast majority of the martyrs whose bodies are held do not meet the conditions imposed by the court, making this issue a new phase in the role played by the so-called Supreme Court in consolidating the crime of holding martyrs' bodies. This was followed by efforts by the Israeli Knesset to legislate a law authorizing the occupation police to hold martyrs' bodies, and later an amendment was made to the "Anti-Terrorism Law."
**Holding Martyrs' Bodies Since the Start of the Genocide:**
The ongoing genocide against our people in Gaza has brought about transformations on all levels, with the enormous crimes committed by the Israeli occupation. The issue of martyrs' bodies is one of the most prominent of these issues, with the number of bodies held by the occupation increasing. After the war, the number of bodies held reached 149, which constitutes more than half of the martyrs held since 2015. This number does not include the martyrs from Gaza whose bodies are held, estimated to be in the hundreds.
To this day, there is no official statement from the occupation regarding the actual number of bodies held from Gaza, in addition to the fact that the occupation employs a policy of concealing identities as another face of the systematic crime of enforced disappearance, instead assigning numbers to the bodies. The only information that has emerged regarding the bodies of martyrs from Gaza held by the occupation was in July 2024, when the Hebrew newspaper Haaretz revealed in an article that the Israeli occupation holds about 1,500 bodies of Palestinians whose identities are unknown, stored in refrigerated containers inside the military base known as Sdeh Teiman, and they were classified by numbers rather than names. The newspaper mentioned that the condition of the bodies had reached a certain stage of decomposition, with some missing limbs and others without identifiable features.
During the war, the occupation handed over the bodies of 428 unidentified martyrs in several batches, and they were buried in mass graves in Khan Younis and Rafah in the southern Gaza Strip. The scene of the occupation handing over the bodies of martyrs in blue bags was one of the most striking images, reflecting the level of savagery of the occupation and its disdain for human dignity as one of the aspects of the ongoing genocide for more than ten continuous months.
**Holding Martyrs' Bodies in Violation of International Conventions and Charters:**
This policy contradicts all international customs and charters that stipulate respect for the victims and the return of their bodies. The relevant rules of international humanitarian law concerning the treatment of the dead, their remains, and their graves include Rule 112 on searching for and collecting the dead, Rule 113 on protecting the dead from pillage and mutilation, Rule 114 on the return of the dead's remains and their personal belongings, Rule 115 on the disposal of the dead, and Rule 116 on identifying the dead.
The First Geneva Convention of 1949, in Article 17, emphasizes the importance of decent and respectful burial, stating that the parties to the conflict must "ensure the dead are honorably interred, if possible according to the rites of the religion to which they belonged, that their graves are respected, grouped according to nationality, and properly maintained and marked so that they can always be found."
In addition to Article 17 of the First Geneva Convention, Article 120 of the Third Geneva Convention, Article 130 of the Fourth Geneva Convention, and Article 34 of the Additional Protocol require facilitating the return of the bodies and remains of the dead.
The National Campaign for the Retrieval of Martyrs' Bodies and Palestinian human rights organizations renew their constant demand for the international legal system to resume its necessary role in stopping the genocide and to stand up for humanity by addressing the terrifying state of paralysis that surrounds its role in the ongoing Palestinian tragedy that has persisted for decades and to exert pressure to free the bodies of our martyrs.
**Free the Martyr Captives' Bodies, Free the Martyr Captives:**
We have names... We have a homeland.

Constant suffering of sick detainees in Ramla prison, in addition to deprivation of treatment and medication

September 1, 2024

The Commission of Detainees’ Affairs stated that detainees held in the so-called Al- Ramla prison clinic are suffering from difficult health conditions, in the light of deliberate medical neglect and deprivation of treatment and medicine.

The Commission cited two cases for detainees who suffer from difficult conditions in the clinic, as they are exposed to the policy of slow killing. For instance, detainee Ibrahim Naanish from Tulkarem, who was arrested after being injured in an explosion by the Israeli army. He had injuries in the abdomen and back, and underwent a surgery in which part of his intestines have been removed. Fragments still exist in his body, which made sores in his back and foot, and he moves using a wheelchair.

With regard to detainee Muhammad Kdairat from Hebron, he suffers from cancer in the lymph nodes since 2009. He had a surgery to implant a marrow in 5/2/2024, and needs biological therapy and special medication. However, the IPS did not provide him any treatment. He was transferred to Ofer prison, despite his serious health condition.

The Commission warned of the international failure towards Palestinian detainees, especially sick ones, and stressed on the necessity of fast intervention to oblige Israel to be committed to the international laws and conventions related to detainees.
It is worth mentioning that the number of sick detainees has exceeded 800, including cases of cancer, in addition to hundreds of injured detainees who suffer from torture since October 7.

*The IPS is isolating detainee Khalida Jarrar since 16 days in tragic conditions in Neve Tirza prison*

*Jarrar to the lawyer: “ I am suffocating in my cell, waiting hours to pass hoping to find oxygen to breath and stay alive “*

The Commission of Detainees’ Affairs and the Palestinian Society Prisoner’s Club “we hold the occupation fully responsible for the fate and life of detainee Jarrar”

August 28, 2024

Ramallah- The Commission of Detainees’ Affairs and the Palestinian Society Prisoner’s Club stated that the IPS held the human rights activist Khalida Jarrar in the isolation of Neve Tirza prison since 16 days, in miserable and difficult conditions.

During a visit managed by the commission’s lawyer, it was confirmed that Jarrar is facing intolerable tragic circumstances. She recounted: “I am dying every day, the cell resembles a closed small can, there is a toilet in the cell and a small window above, which was closed after one day. They left no way to breathe, where there is a narrow vent that I set next to most of the time to breathe. I am really suffocating in my cell, waiting time to pass , hoping to find oxygen to breathe and stay alive “.

Jarrar added: “ the high temperature increased the tragic condition of my isolation, as i feel myself existing in an oven. I can’t sleep due to the high temperature, and they intended to cut off the water in the cell, and when I asked to refill my bottle of water they bring after 4 hours at least. They let me out to the prison’s courtyard only once after 8 days of isolation. In addition, they intended to delay the food for hours “.
The commission and the prisoner’s club confirmed that the isolation of Jarrar is a deliberate crime committed by the IPS, which refused to disclose the duration or the reason behind her isolation.

In this context, the commission and the prisoner’s club hold the occupation fully responsible for her life and fate, and considered this violation as an extension of the unprecedented systematic measures imposed on detainees since the beginning of the genocide.
She was re-arrested in 26/12/2023, and sentenced to administrative detention. She was held in Damoun prison until she got isolated recently.
She has been held for five years previously, where she is a human rights activist and a representative in the legislative council.

She is among (87) women detainees in Israeli prisons, where the majority of them are held in Damoun prison.
It is worth mentioning that the occupation authorities escalated in detention campaigns, as (355) women have been arrested since the genocide, excluding tens of Gazan detainees.

Negev prison,, a graveyard of living

August 25, 2024

The Commission of Detainees’ Affairs stated that the Israeli authorities and the IPS pursued retaliatory measures since the beginning of aggression last October to crack down on detainees, as they intended to suppress, torture and deprive them of the simplest rights. As a result, many detainees had lost their lives, while others were subjected to dangerous injuries, dermatological diseases, weight loss and fatigue, in addition to medical neglect and deprivation of medication.

In this context, the lawyers of the commission managed to visit Negev prison to check on their living conditions and document the fascism and racism they are experiencing. They met the following detainees:
1. Detainee Qusai Hsais, 20, who was arrested in 4/11/2023. He suffers from scabies and has critical health condition, as he was scratching throughout the visit. He requested treatment but the administration refused, and mentioned that he couldn’t not sleep for days, and that 10 of his colleagues suffer from the same disease.
2. Detainee Ayman Mahmoud Atshan, 29, from Ramallah. He was arrested in 1/11/2023. He has severe pain in his broken ribs due to intense beat. He confirmed that there are no cameras in some places in the prison, in which detainees are subjected to intense beat and torture.

The commission called on the international human rights organizations and the international committee of the Red Cross to stand with detainees and take their responsibility to stop these systematic crimes and extrajudicial killings against thousands of our people inside the Israeli prisons.
