Palestinian detainees in Israeli prisons after October 7, 2023

Since occupying Palestine in June 4, 1967, detention operations have constituted one of the most prominent policies pursued against Palestinians. More than one million detention cases of Palestinians have been recorded, including all categories of the Palestinian society of women, children, elderly, academics, journalists, political and social activists and strugglers, who look for the freedom of nation, land and humans.

 

The occupying state has not shown, at any stage of the Palestinian-Israeli conflict, any concern for the rules of the international legal system, or the international treaties, laws and agreements. However, Israel tried to consolidate more systematic crimes, relying on racist laws and legislations that violate the core of human rights, thereby it obviously violated all international resolutions. This has not been limited to any particular stage, as the successive Israeli governments have pursued and developed more measures to impose higher levels of control and supervision over Palestinians through the apartheid system. These methods have affected all aspects of the Palestinian life, where the cause of Palestinian detainees has constituted the most prominent issues reflecting the extent of systematic violations and crimes that the occupying state has entrenched through its prison’s system.

 

The occupying state has used the cause of Palestinian detainees for decades as a central tool in its internal political conflicts, through systematic competitions to impose more crimes and restrictions against Palestinians. This was evident in the Israeli election campaigns, as well as during wars and political upheavals.  The incitement for revenge against the detainees intensifies to gain supporters and increase votes.

 

The occupation army carries out arbitrary arrest operations on a daily basis across the occupied Palestinian territories in a brutal manner, as these arrests have turned into a part of the Palestinian life. Detention operations commence by identifying the targeted house, storming it, and exploding its doors, often in the midnight to intimidate everyone inside, using all means of violence, including intensive beatings, assaults, and forcing the family to gather in a specific place in the house. Then, inspections, vandalism and destruction of property are carried out in a provocative and vengeful manner for several hours.

 

The detainee is then transported in a military vehicle to the army camps and then to detention and interrogation centers, then transferred to one of the central prisons. Afterwards, show trials begin, based on racist military orders and laws aiming at conquering and punishing Palestinians.

 

Throughout these stages, detainees are exposed to all forms of torture, mistreatment, and humiliation, turning their arrest into a multi-layered crime that violates international legal and human rights standards.

 

Over decades of struggle by Palestinian detainees to regain their legitimate rights and confront the attempts of deprivation, they were able to impose a special regime and detention conditions, through several steps of struggle, in which many detainees were martyred. Their struggle was represented in open hunger strikes, as detainees became able to gain the minimum of their rights, which enabled them to overcome the racist rules and regulations of the occupation.

 

As we previously mentioned, everything achieved by detainees had a heavy price, starting from pens, newspaper, magazines, TVS, radios, education, medical treatment, cooking inside rooms, breaks, canteens, families and lawyers visits and many other simple rights.

 

After October 7, 2023, the prison’s administration began operations of systematic and collective torture conducted by Special Forces subordinate to the IPS, who deprived detainees of their simplest rights. In coincidence with the war on Gaza, the IPS launched a parallel war inside the Israeli prisons, headed by the extremist Minister of National Security, Itamar Ben Gvir, and the government of settlers who lead Israel nowadays. This war is represented in storming prison’s rooms and sections, turning them into cells, practicing assault and humiliation, confiscating detainees’ belongings, such as clothes and blankets. Each detainee only has a thin blanket, a thin cover and the clothes he wears on.

Moreover, the IPS has closed the canteen and canceled the break.

Attacks and assaults included severe beating, led to fractures in the limbs and the chest, and the corridors were full of blood. As a result, 40 detainees were martyred, whom identities are known, where the occupation’s media has announced the martyrdom of tens of detainees from Gaza.

 

Retaliatory policies have been imposed on detainees, including war crimes, such as torture, enforced disappearance, starvation, deprivation of treatment and medication, canceling family visits, canceling lawyers' visits, in addition to the overcrowding in prisons due to the increasing daily arrests. Indeed, the prisons were turned into places of torture.

 

It is important to highlight the seriousness of changes that affected the cause of detainees through digital transformations. By the end of last October, the total number of detainees held in Israeli prisons was (5250), including (40) women, (170) children, (700) sick detainees and (1320) under the administrative detention, which is a precautionary detention, without charges or trials.

Since that time, especially after October 2023, changes have been imposed on the cause of detainees and detention cases, as data began to accelerate due to the daily arrests.

 

(10100) Palestinian detainees are currently held in Israeli prisons, including (3398) detainees under the administrative detention, making it the highest number of administrative detainees in the history of the Captive Movement since the first uprising, in addition to (95) women and (270) children.

 

(11.100) arrest cases have been recorded in the West Bank and Jerusalem, including (420) arrests cases for women and (740) cases for children. Furthermore, (9000) orders of administrative detention have been issued, in addition to arresting thousands of detainees from Gaza Strip. However, the exact number of detainees from Gaza cannot be determined due to the policy of enforced disappearance imposed on them by the Israeli occupation authorities. It is worth mentioning that the majority of detainees from Gaza were classified as illegal fighters, which is another form of administrative detention applied in the West Bank.

 

During the past few months, we were able to document hundreds of testimonies from released detainees, and other detainees who were visited by our legal teams. These testimonies carried shocking and horrifying facts, that revealed torture, severe beating and rape  by soldiers and police dogs, in addition to the methods they pursued in using the detainees’ families, wives, mothers, fathers and children as hostages and human shields, as well as assaults, curses and ongoing humiliation.

The prisons’ administration has turned these crimes and procedures into a systematic consistent reality. For instance, they pursued the crime of starvation against detainees, which led to the loss of 25 kgs for each detainee and resulted in consistent health problems, where this crime became a key factor that threatens detainees’ fate. The policies of the IPS concentrated on pursuing means of humiliation and degradation in order to affect the spirit of Palestinian detainees and deny their humanity, in addition to the systematic medical crimes which constituted the main reason for the martyrdom of many detainees.

 

It is necessary to highlight the policy of enforced disappearance against detainees from Gaza, as the Israeli occupation has arrested thousands of citizens from Gaza Strip, including workers who were residing in the lands occupied in 1948 for work, as well as civilians who were arrested throughout the ground invasion.

We have seen hundreds of people piled up on military vehicles, naked and in humiliating circumstances, as they were taken to military camps. During the past months, the occupation authorities refused to disclose any information about their identities and numbers. However, we were able to have some information from released detainees. Furthermore, the occupation authorities have prevented the International Committee of the Red Cross from visiting detainees, where all international human rights organizations failed to stop the horrific crimes of the occupation.

 

The crime was not limited to the enforced disappearance, as the violations experienced by detainees from Gaza were never reported in prisons throughout the history.

The Israeli soldiers revealed their brutality and practiced many crimes in dealing with detainees. They documented their crimes by themselves through filming the torture and assault against detainees, challenging the world by their inhumane and unethical behaviors.

We are still paying the price for this policy, and still living in a state of anxiety and fear for thousands of Palestinians from Gaza about whom we know nothing.

There are many testimonies from recently released detainees from Gaza or those whom lawyers managed to visit inside prisons and detention centers, speaking about killings and executions carried out in front of them. It is worth mentioning that among the thousands abducted by the occupation from the Gaza Strip, 1.618 detainees were acknowledged by the occupation and classified as illegal fighters.

According to the above mentioned data, we confirm that all these crimes have afflicted women, children, elderly, sick people and people with special needs, and we also confirm that these crimes amount to war crimes and crimes against humanity, where the language cannot describe what we have heard of testimonies and stories from detainees. This showed a state of failure by the international community and human rights organizations in light of the horrific crimes committed against our people in Gaza and the aggression against Palestinians in general in all the occupied territories, in addition to violations and crimes committed against male and female detainees held in Israeli prisons.

The head of the Commission of Detainees’ Affairs, Qaddura Fares, briefed a group of French parliamentarians consisting of 40 deputies from the Front of left wing parties, on Wednesday, about the tragical conditions of Palestinian detainees held in Israeli prisons, and the procedures and laws imposed on them, that breach all international laws and norms.

Fares illustrated, in the presence of the exiled former detainee, Salah Hammouri, the general changes on detainees’ conditions since October 7, which turned their lives into hell due to torture, starvation and medical neglect policies.

Fares demonstrated the changes happened after few hours of the October 7 incidents, where the oppressive special forces, accompanied by thousands of Israeli army, stormed the prisons and confiscated detainees’ personal belongings, including clothes, blankets, kitchen tools, TVs and radios. Additionally, they closed the canteen, prevented the break and isolated the majority of them.

Fares added: “assaults, beating and torture practiced against detainees were never experienced by the Captive Movement, as breaking detainees’ bones, bloodshed, handcuffing, intensive interrogation and deprivation of medical care have became a daily routine, in addition to execution and enforced disappearance, especially against detainees from Gaza.

Moreover, prisons witnessed an unprecedented overcrowding due to the daily campaigns of detention, as (10700) arrest cases have been recorded since October 7, 2023, and the total number of detainees held in Israeli prisons stands at (9900), in addition to thousands of detainees from Gaza.

Fares called for the formation of an international parliamentary body and the establishment of a global alliance to support the Palestinian people in obtaining their rights of freedom, independence and resisting the Israeli policies and crimes committed by the Zionist occupation against Palestinians in general and detainees in particular.

For his part, the exiled former detainee Salah Hammouri, shared his personal experience of detention, confirming that the occupying state does not take into consideration the international system, and said that it is time for Palestinians to obtain their rights of freedom and justice.

Statement issued by Detainees’ Institutions concerning detainees from Gaza and the martyrs and detainees in Israeli prisons since the beginning of genocide war

 

The Israeli occupation never stopped targeting Palestinian detainees in prisons. The war of genocide was an extension of long decades in which the occupation practiced systematic crimes, such as torture and medical crimes, that led to the martyrdom of hundreds of detainees over the years of occupation.

Since the beginning of war, tens of detainees from all Palestinian cities were martyred, where the cause of martyr detainees from Gaza constituted the most significant challenge to human rights organizations in light of practicing the crime of enforced disappearance against them, and the occupation’s refusal to disclose their information or the conditions of their martyrdom.

Over the past months, several human rights groups have followed this case, which was accompanied by torture, medical crimes, rape, and sexual assaults, reflected in the testimonies of released detainees.

Detainees’ institutions were able to disclose the fate of hundreds of detainees from Gaza, and managed lawyer visits in some prisons and military facilities. However, there are hundreds of detainees who are subject to enforced disappearance.

Based on the following of Palestinian human rights organizations we confirm on the following:

First: we confirm that, to this day, there is no clear data on the number of detainees from Gaza, except for the figure announced by the IPS this October, which stands at (1618) , who have been classified as illegal fighters. However, based on our following and documenting process, there are thousands of detainees from Gaza.

Second: concerning the number of martyrs, we clarify the following:

(40) detainees were martyred in Israeli prisons and military facilities since the war of genocide, whom identities are known, including (14) from the West Bank and Jerusalem, (2) from the lands occupied in 1948, and (24) from Gaza. We have announced the names of (25) martyrs, and today we announce (15) additional names from Gaza, whom have been announced as martyrs by the Israeli authorities, except for Dr. Iyad Rantisi, whom the Haaretz newspaper announced his martyrdom.

Third: we affirm that the announced (24) martyrs from Gaza is not final, as their numbers are estimated to tens, according to the Israeli media and Israeli human rights organizations. We confirm that the number we have announced is for those whom we had their names and information by the Israeli army about the date of their arrest and martyrdom. ( Commission of Detainees’ Affairs, Palestinian Society Prisoner’s Club, Addameer Association for Human rights, Hamoked and Maslak).

 

Fourth: Fourth: We affirm that the Israeli army's response concerning the martyrdom of Gaza detainees remains uncertain and doubtful as there is no evidence provided by institutions confirming their martyrdom, especially as the occupation continues to withhold their bodies. We note here that some responses from the Israeli army referred to an ongoing investigation by the occupation, attempting to avoid international prosecution by claiming internal legal follow-ups. However, experience has shown that these investigations are superficial and ineffective, as they lead to no accountability. The occupation’s judicial system, is merely a tool in the hands of the political parties, contributing to the entrenchment of the crime.

Fifth: in spite of the belief entrenched by the experience on the superficiality of these investigations, we as detainees institutions will continue the legal pursuit, on the behalf of the martyrs families, whose names are known. They have the right to participate and know the conditions of their martyrdom. This pursuit is to confirm on the right of their families to legal pursuit and follow up on asking for returning their bodies.

Sixth: the total number of martyrs whose identities are known since 1967 stands at (277) , after adding (15) martyrs, announced by detainees institutions.

More than (8872) orders of administrative detention have been issued since October 7, ranging between new orders and renewals, including orders against children and women.

Detention campaigns carried out since October 7 are accompanied by escalated crimes and violations such as humiliation, brutal beat, threats against detainees and their families, besides to vandalism and destruction in detainees’ houses, confiscating vehicles, gold and money, in addition to the destruction of infrastructure especially in the refugee camps of Tulkarem and Jenin.

Statistics include detainees who were arrested from their houses, on checkpoints, who surrendered themselves and those who were arrested as hostages.

Besides to detention campaigns, the Israeli forces implemented field executions, afflicted detainees and their family members.

The remains of (23) detainees who martyred after October 7 are still withheld, among (34) martyrs.

Data exclude detention cases of Gaza, due to the occupation’s refusal to give any information and the continuation of practicing the crime of enforced disappearance against them. It is worth mentioning that the occupation forces arrested about (4500) citizens from Gaza, in addition to hundreds Gazans who have been arrested in the West Bank.

The total number of detainees held in Israeli prisons stands at(9900), including (3323) administrative detainees, in addition to (1612) detainees who have been classified as illegal fighters.

Detainees held in Jelboa prison are living in difficult detention conditions

The Commission of Detainees’ Affairs stated that detainees held in Jelboa prison are living seriously under difficult conditions, due to the Israeli policies and variants imposed since October 7. These policies have turned prisons into real graves, in which torture and abuse are practiced, leading to the martyrdom of tens of detainees from different Palestinian cities.

The department of legal affairs in the commission recounted, after a visitation to the detainee Naser Shaweesh who is sentenced to 4 terms of life imprisonment, the details of the conditions lived by detainees in Jelboa prison, where the administration if prison confiscated all their belongings, without taking into account sick and elderly detainees. They turned the rooms into cells, as detainees are prevented from break and smoking, and completely isolated from the outside world. Moreover, detainees are deprived of clothes, blankets, razors, nail clippers, in addition to the fines and sanctions imposed against them.

The commission stated that the plight of sick detainees is increasing day by day, as there is no medical care, and detainees are just provided with painkillers.

The commission warned of this ongoing hatred of Israel against our detainees, and confirmed that the violations committed against detainees in Jelboa prison are applied to all prisons.

Detention campaigns carried out since October 7 are accompanied by escalated crimes and violations such as humiliation, brutal beat, threats against detainees and their families, besides to vandalism and destruction in detainees’ houses, confiscating vehicles, gold and money, in addition to the destruction of infrastructure especially in the refugee camps of Tulkarem and Jenin.

Statistics include detainees who were arrested from their houses, on checkpoints, who surrendered themselves and those who were arrested as hostages.

Besides to detention campaigns, the Israeli forces implemented field executions, afflicted detainees and their family members.

*The highest record of arrest cases was in Hebron and Jerusalem*

🔴 (24) detainees martyred in Israeli prisons and military camps since the 7th of October, in addition to tens martyrs from Gaza who died in Israeli prisons and detention centers, whom the occupation has not announced their names or martyrdom conditions. Moreover, they acknowledged the execution of many detainees.

The remains of (22) detainees who martyred after October 7 are still withheld, among (33) martyrs.

Data exclude detention cases of Gaza, due to the occupation’s refusal to give any information and the continuation of practicing the crime of enforced disappearance against them. It is worth mentioning that the occupation forces arrested about (4500) citizens from Gaza, in addition to hundreds Gazans who have been arrested in the West Bank.

🔴 *Total number of detainees held in Israeli prisons until September 2024*

The total number of detainees held in Israeli prisons stands at(9900), including (3323) administrative detainees, in addition to (1612) detainees who have been classified as illegal fighters.

.(96) female detainees are held in Damoun prison, including a pregnant detainee (Jehad Nakhleh) and (3) detainees from Gaza, in addition to (23) administrative detainees. These figures exclude women detainees from Gaza, as there might be detainees held in military camps and facilities of the occupation.

. (250) children are currently held in isolation prisons

Ramallah- The administration of Nafaha and Remon prisons informed the lawyers who manage visits to detainees about the cancellation of all visits without determining the duration, claiming the imposition of quarantine due to the spread of scabies disease among detainees.

The commission and the prisoner’s club confirmed in a joint statement that the disease has spread among detainees in several prisons, especially (Negev, Megiddo, Nafaha and Remon), due to the retaliatory measures imposed on detainees, which are part of the systematic and escalating policies of torture and abuse against them.

The commission and the prisoner’s club emphasized, based on testimonies recounted by lawyers who visited detainees and liberated detainees, that the scabies has been spreading in central prisons several weeks ago. They confirmed that the administration of prisons has turned the disease as a means of torture and assault and medical crimes, such as deprivation of treatment and medication, and failing to take the necessary measures to prevent the disease from spreading.

Many reasons were behind the spread of the disease, which are represented in the lack of cleaning materials, decreasing water use and the duration of showers, withdrawals of clothes, in addition to the overcrowding inside sections, the daily arrests, poor ventilation, and the isolation of detainees in cells devoid of sunlight have contributed to the spread of diseases.

The commission and the prisoner’s club stated that the most serious crime committed by the administration of prisons against detainees despite the spread of the disease is the deliberate transfer of detainees between sections, which led to the increase of infections, especially children detainees who exist in minor’s section in Megiddo prison.

The commission and the prisoner’s club hold the administration of prisons fully responsible for detainees’ fate, as tens of sick detainees who have chronic diseases are held in prisons in which the disease spread.
